These Terms of Service ("Terms") govern your use of HipErlink, a mobile application and marketplace operated by Hiperlink Inc. ("Hiperlink", "we", "us"), a company registered in Ontario, Canada. By creating an account or using HipErlink, you agree to these Terms. If you do not agree, do not use the app.
Zero-Tolerance Policy for Objectionable Content and Abusive Users
HipErlink has a zero-tolerance policy for objectionable content and abusive behavior. You agree not to post, share, transmit, or send any content that is offensive, harassing, hateful, threatening, defamatory, sexually explicit, violent, discriminatory, illegal, or otherwise objectionable. You agree not to harass, abuse, stalk, impersonate, or harm other users.
Content that violates this policy, and users who engage in abusive behavior, will be removed. We review reports and act on objectionable content and abusive users within 24 hours, which may include removing content and suspending or permanently banning accounts. There is no appeal for accounts removed for serious violations.
1. Eligibility and Accounts
You must be legally able to enter into these Terms to use HipErlink. You are responsible for providing accurate account information, keeping your login credentials secure, and all activity that occurs under your account.
2. User Content and Conduct
HipErlink allows users to post videos, product listings, comments, ratings, and to send messages to other users. You are solely responsible for the content you post, send, or share. By posting content, you confirm you have the right to do so and that it does not violate these Terms or any law.
You agree not to:
- Post or send objectionable content as described in our zero-tolerance policy above;
- Harass, threaten, abuse, or impersonate other users;
- Post false, misleading, or fraudulent listings or information;
- Infringe the intellectual property or privacy rights of others;
- Use the app for any unlawful purpose.
3. Reporting and Blocking
You can report any post, comment, message, or user directly within the app. You can also block other users, which prevents them from contacting you or interacting with your content. We encourage you to report any content or behavior that violates these Terms. To report abuse, contact support@hiperlink.io.
4. Sellers
Sellers are responsible for the products and services they list, including descriptions, pricing, availability, and fulfillment. HipErlink is a marketplace that connects buyers and sellers; Hiperlink Inc. is not the seller of items listed by third parties and is not responsible for the quality, safety, legality, or warranty of items offered by sellers. Sellers keep 100% of their sales; HipErlink charges no commission and instead offers a subscription for storefronts.
5. Payments
Payments are processed by our third-party payment provider. HipErlink does not store your full card details. For eligible orders, funds are held until the order is confirmed as delivered, and then released to the seller. Refunds and disputes are handled in accordance with applicable law and our policies.
6. Intellectual Property
HipErlink, its logo, and its content (excluding user content) are the property of Hiperlink Inc. You may not copy, modify, or distribute them without permission. You retain ownership of the content you post, but grant HipErlink a licence to display and distribute it within the app for the purpose of operating the service.
7. Termination
We may suspend or terminate your account at any time if you violate these Terms, including our zero-tolerance policy. You may stop using HipErlink and delete your account at any time.
8. Disclaimers and Limitation of Liability
HipErlink is provided "as is". To the fullest extent permitted by law, Hiperlink Inc. disclaims all warranties and is not liable for indirect, incidental, or consequential damages arising from your use of the app or from transactions between users.
9. Governing Law
These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein. Any disputes shall be subject to the courts of Kingston, Ontario.
10. Changes to These Terms
We may update these Terms from time to time. Continued use of HipErlink after changes take effect means you accept the updated Terms.
